Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service. The end user license agreement (EULA) that governs your use of the app is Apple's standard Licensed Application End User License Agreement, available at: ### 1. ACCOUNT REGISTRATION You are not required to register an account to browse the Service, but access to certain features requires registration. When you register, you agree to provide accurate, current, and complete information and to update it as necessary. You are responsible for maintaining the security of your account and all activities that occur under it. Each account is for individual use only and may not be shared with any other person. ### 2. ELIGIBILITY The Service is intended for users who are **13 years of age or older**. Minors under the age of majority in their jurisdiction may use the Service only with the consent and supervision of a parent or legal guardian. You must be of legal age to form a binding contract in order to purchase a subscription. By using the Service, you represent and warrant that: (a) all information you submit is truthful and accurate; (b) you will keep such information current; and (c) your use of the Service complies with all applicable laws and regulations. ### 3. SUBSCRIPTIONS We offer auto-renewable subscription plans that provide access to premium features and content. By purchasing a subscription, you agree to pay all applicable fees and taxes. Subscriptions are billed in advance on a recurring basis through your Apple App Store account and are non-refundable unless required by law. **Available plans:** * **Monthly** — automatically renews every **1 month** from the date of activation until you cancel. * **3-Month** — automatically renews every **3 months** from the date of activation until you cancel. * **6-Month** — automatically renews every **6 months** from the date of activation until you cancel. Prices are displayed in the app before purchase and are charged in your local currency. **Automatic Renewal:** Your subscription automatically renews unless auto-renew is turned off at least **24 hours before the end of the current period**. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price of the plan you selected. **Managing and Canceling:** You can manage or cancel your subscription at any time through your Apple ID account settings (Settings → your name → Subscriptions). Cancellation takes effect at the end of the current billing period, after which your account reverts to the free tier. Deleting the app does not cancel your subscription. **Free Trials:** We may offer a free trial period for new users. The trial duration will be specified at sign-up. If you do not cancel at least 24 hours before the trial ends, you will be charged for the subscription automatically. Free trials cannot be combined with other promotional offers. **Price Changes:** We may change subscription prices. Price changes will be communicated in advance and take effect on your next renewal date. Continuing your subscription after a change takes effect constitutes acceptance of the new price; if you do not agree, you may cancel before it takes effect. **Refunds:** Except where required by applicable law, subscriptions are non-refundable. Refunds for App Store purchases are handled by Apple, and you may request one directly through Apple. **Termination of Access:** Upon cancellation, termination, or expiration of your subscription, you will no longer have access to premium features unless you purchase a new subscription. ### 4. USE LICENSE You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes only. This license terminates automatically if you violate these Terms and may be terminated by us at any time. Upon termination, you must cease all use of the Service and destroy any downloaded materials. ### 5. INTELLECTUAL PROPERTY All content, features, and functionality on the Service — including text, images, graphics, logos, audio, video, and software — are the exclusive property of **\[COMPANY LEGAL NAME]** and its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from the Service without our prior written consent. ### 6. USER CONDUCT You agree not to use the Service in any unlawful, harmful, or objectionable manner. This includes, but is not limited to: * Harassing, defaming, or threatening others; * Uploading or transmitting viruses, malware, or other harmful files; * Violating any applicable laws, regulations, or third-party rights. You specifically agree not to: (i) Copy, reproduce, distribute, display, or create derivative works from content on the Service; (ii) Remove, alter, or obscure any copyright notices, trademarks, or other proprietary markings; (iii) Use automated tools such as bots, spiders, or scrapers to access the Service; (iv) Decompile, reverse engineer, or disassemble any software or products accessible through the Service; (v) Manipulate or insert code into the Service; (vi) Use data mining, data gathering, or extraction methods; (vii) Upload or transmit any material designed to damage, disable, or interfere with computer systems or the Service. We may terminate or restrict your access to the Service if you violate these Terms or engage in illegal or fraudulent activity. ### 7. TERMINATION We may terminate or suspend your account and access to the Service at any time, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that should reasonably survive termination shall remain in effect, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability. ### 8. ACCOUNT DELETION AND DATA RETENTION You have the right to delete your account at any time through your account settings or by contacting our support team. Once deleted, all data associated with your account will be permanently removed and cannot be recovered. We reserve the right to delete user data, including user-generated content, if an account has no active subscription and has been inactive for an extended period. We will make reasonable efforts to notify you before taking such action. This helps us maintain system performance and security. ### 9. DISTRIBUTION The **Dilexa** mobile applications are distributed through the Apple App Store for iOS and the Google Play Store for Android. By downloading and installing the app, you agree to comply with the terms, guidelines, and policies of the respective app store. ### 10. ACKNOWLEDGEMENT By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, our Privacy Policy, and the applicable EULA. You are responsible for complying with all applicable laws and regulations in your jurisdiction. ### 11. DISCLAIMER AND LIMITATION OF LIABILITY EXCEPT AS OTHERWISE EXPRESSLY STATED, ALL CONTENT AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE, OUR SUPPLIERS, AND LICENSORS MAKE NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. YOU UNDERSTAND AND AGREE THAT YOU USE THE SERVICE AT YOUR OWN RISK, AND THAT WE WILL HAVE NO LIABILITY FOR ANY DAMAGE TO YOUR DEVICE, SYSTEM, OR DATA THAT RESULTS FROM USING THE SERVICE. IN NO EVENT WILL WE, OUR SUBSIDIARIES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, BUSINESS INTERRUPTION, OR LOSS OF DATA, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR AGGREGATE LIABILITY FOR ALL CLAIMS EXCEED THE AMOUNTS YOU PAID TO US DURING THE 12 MONTHS PRIOR TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU. ### 12. INDEMNIFICATION You agree to defend, indemnify, and hold harmless us, our subsidiaries, contractors, licensors, and their respective directors, officers, employees, and agents from any claims, damages, and expenses, including attorneys' fees, arising from your use of the Service or any violation of these Terms. ### 13. SEVERABILITY If any part of these Terms is held invalid or unenforceable, that part will be construed to reflect the original intent, and the remaining portions will remain in full force and effect. ### 14. NON-WAIVER OF RIGHTS A waiver by either party of any term or condition, or any breach thereof, will not waive such term or condition or any subsequent breach. Any waiver must be in writing. ### 15. ASSIGNMENT You may not assign your rights under these Terms without our consent. We may assign our rights under these Terms without restriction. These Terms will be binding upon and inure to the benefit of the parties and their successors and permitted assigns. ### 16. GOVERNING LAW These Terms shall be governed by the laws of Turkmenistan, without regard to its conflict-of-law provisions. ### 17. LINKS The Service may contain links to third-party websites or resources. Because we have no control over such sites, you acknowledge and agree that we are not responsible for the availability, content, or accuracy of external sites, and we are not liable for any damage or loss caused by your use of or reliance on any third-party content or services. ### 18. CHANGES TO THESE TERMS We may modify these Terms at any time. We will post the updated version with a new "Last Updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. ### 19.
